Terms and Conditions

These Terms govern the sale and delivery through the portal of paid access to official prebuilt binary distributions of LichtFeld Studio, along with related hosted delivery, invoicing, account administration, and optional supporter benefits such as Discord roles or sponsor listings where offered.

Access is assigned to the account and release window shown in the portal. Stable and nightly builds may be made available separately.

LichtFeld Studio remains open source software distributed under GPLv3. These Terms govern only the commercial transaction and the hosted service relating to official binary delivery and associated portal services, and do not alter, replace, restrict, or supersede the GPLv3 license applicable to the software itself.

Nothing in these terms limits any right granted under GPLv3, including rights to run, study, modify, and redistribute the GPL-covered software as permitted by that license.

Project names, logos, and other trademarks remain reserved except to the extent expressly permitted by applicable trademark law or a separate written permission.

• You must provide accurate and complete account and billing information and keep it up to date.
• You are responsible for all activity occurring under your account and for maintaining the confidentiality of your login credentials.
• You must not share your portal login credentials or misuse, transfer, resell, or systematically distribute or abuse time-limited signed download links issued by the portal.
• We may suspend, restrict, or revoke access where reasonably necessary for security, fraud prevention, sanctions compliance, abuse mitigation, or non-payment.

Prices shown in the portal or at checkout are the prices applicable for the selected access tier and related services at the time of purchase.

Any applicable taxes, including VAT treatment, are handled in accordance with Swiss law and any other mandatory tax rules applicable to the transaction. The customer is responsible for providing correct billing details.

Access is activated only after successful payment confirmation or a manual waiver recorded on the account. The portal may use third-party payment providers, including Stripe, for secure checkout and tax-related data capture.

Invoices are made available through the customer account after payment confirmation when the required billing details are present.

Downloads are delivered through the portal by secure hosted links. Access is limited to releases currently assigned to the account and may be subject to version windows, channel restrictions, usage controls, and other reasonable technical or security measures.

Any public description of a plan, release window, or benefit reflects the current offer. For a completed transaction, the access actually owed is determined by the checkout record and the portal grant assigned to the account.

Nightly or preview builds are experimental. They may be unstable, incomplete, changed without notice, or removed from the portal at any time without prior notice.

We do not guarantee uninterrupted or error-free availability of the portal, hosting, storage, payment providers, email delivery, or third-party services.

Discord roles, sponsor listings, logos, acknowledgements, and similar supporter benefits are optional service benefits associated with the portal offering. They do not constitute separate software-license rights.

Sponsor recognition is subject to availability, placement limits, accurate asset delivery, reasonable brand review, and third-party platform availability. We may refuse, edit, delay, or remove recognition materials that are misleading, infringing, unlawful, abusive, technically unsuitable, or otherwise unreasonable.

Unless expressly agreed in writing, no portal tier includes custom development, guaranteed response-time commitments, consultancy, exclusivity, endorsement rights, or guaranteed promotional placement.

Except where mandatory law provides otherwise, payments for activated access to official binary builds and related portal services are non-refundable.

Nothing in these Terms excludes or limits any rights or remedies that cannot be excluded or limited by applicable law.

If consumer law in your jurisdiction gives you mandatory withdrawal, cancellation, refund, warranty, or conformity rights, those rights remain unaffected by these terms.

If you target EU consumers, the checkout flow should separately present any legally required pre-contract disclosures and any consent needed for immediate digital delivery.

• You must not share credentials, scrape the portal, overload the service, engage in denial-of-service activity, or otherwise abuse the portal by automated or manual means.
• You must not circumvent or attempt to circumvent portal security, access controls, download restrictions, or signing mechanisms.
• You must not use the portal in violation of sanctions, export-control rules, or other mandatory laws.
• You must not misuse sponsor listings, Discord benefits, project branding, or public statements in a misleading, deceptive, or unlawful manner.

The GPL-covered software is provided subject to the warranty terms of GPLv3. The portal and related services are provided on an "as-available" and "as is" basis, to the extent permitted by applicable law.

Unless expressly agreed otherwise in writing or required by mandatory law, the purchase of portal access does not create an obligation to provide a minimum release cadence, future features, compatibility updates, custom work, support-response times, consultancy, or continued hosting of every historical build.

The software and portal are not designed for safety-critical, life-support, or other uses where failure could reasonably be expected to cause death, personal injury, or severe physical or environmental damage.

To the extent permitted by applicable law, we exclude liability for indirect, incidental, special, consequential, or exemplary damages, and cap direct liability to the amount paid for the relevant portal transaction that gave rise to the claim.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.

These Terms, all transactions concluded through the portal, and any non-contractual claims arising out of or in connection with them are governed exclusively by substantive Swiss law.

This excludes the conflict-of-laws rules of Swiss private international law to the extent they would lead to the application of foreign law, and excludes the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For customers acting in the course of a business or professional activity, the exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms or any portal transaction is Basel, Switzerland.

For customers qualifying as consumers under mandatory Swiss law, any mandatory Swiss statutory place-of-jurisdiction rules remain reserved and unaffected.

If any provision of these Terms is or becomes invalid, unlawful, or unenforceable in whole or in part, the validity and enforceability of the remaining provisions are not affected.

Any invalid, unlawful, or unenforceable provision will be replaced by a valid provision that comes as close as possible to the economic purpose of the original provision.

Any failure or delay by us in exercising any right or remedy under these Terms does not constitute a waiver of that right or remedy, nor of any other right or remedy.

We may amend these Terms from time to time.

The version published on this page together with its effective date governs new transactions concluded on or after that effective date.

Material changes should be published before they become effective for future transactions. Unless expressly stated otherwise, changes do not apply retroactively to transactions already completed.
